Research, communication, records and the CFA designation

These cases ask whether a recommendation rested on genuine checking, whether clients were told about material changes in method, whether records back up the advice, and whether the CFA exam and designation were treated with integrity.

In short

  • V(A) Diligence and Reasonable Basis: relying on someone else's research requires checking it; issuer-paid work by an unsupervised independent analyst deserves extra scrutiny.
  • V(B) Communication: disclose the basic investment process and promptly disclose material changes to it, even when the change is an improvement.
  • V(C) Record Retention: keep client records up to date promptly and regularly; knowing clients well is no substitute.
  • VII(A) Conduct in CFA Programs: general reactions to the exam may be shared; specific questions or topics tested may not.
  • VII(B) Reference to CFA: the right to say 'CFA charterholder' requires current membership (paying dues); a colleague who knowingly stays silent while a lapsed member claims it is assisting a violation.
